1.2 Captivation AI Ltd provide a range of Services that include Video Menus for restaurants and V-Guides for tourism.
1.3 By accessing or using the Services, you confirm that you accept these Terms and agree to comply with them. If you do not agree, you must not use the Services.
1.4 These Terms apply regardless of how you access the Services, including via mobile or desktop devices.
2. Nature of the Service
2.1 The Services are an informational and discovery-based digital experiences service designed to assist users through curated and AI-assisted content. The Services are provided for general informational, discovery, and entertainment purposes only.
The Services may include:
tourism recommendations;
venue information;
AI-generated guidance;
multilingual translations;
itinerary suggestions;
destination discovery tools;
links to third-party booking services.
Where the Services includes links to third-party providers, those services are provided independently (see clause 6).
3. Use of the Services
3.1 You may use the Services for your personal, non-commercial use only.
3.2 You agree not to:
(a) use the Services in any way that is unlawful or fraudulent;
(b) interfere with or disrupt the integrity, security, or performance of the Services;
(c) attempt to gain unauthorised access to systems or data;
(d) copy, reproduce, scrape, or commercially exploit any part of the Services without our prior written consent.
4. AI-Assisted Content
4.1 The Services incorporates artificial intelligence systems to assist in generating recommendations, itineraries and other content.
4.2 You acknowledge and agree that:
(a) such content is generated using automated systems and may contain errors, omissions, inconsistencies, or outdated information;
(b) recommendations may not reflect real-time availability, pricing, or operational status of venues or services.
4.3 Accordingly:
(a) all content is provided for general informational purposes only;
(b) it does not constitute professional advice, including travel, safety, legal, or financial advice;
(c) you are responsible for independently verifying any information before relying on it.
4.4 To the fullest extent permitted by law, we make no representation or warranty as to the accuracy, completeness, reliability, or suitability of any AI-assisted content.
4.5 AI-assisted content may be inaccurate, incomplete, subjective, or unsuitable for certain circumstances.
5. User Inputs
5.1 The Services may allow you to provide information, including personal data (for example, email address or preferences).
5.2 You confirm that:
(a) any information you provide is accurate to the best of your knowledge;
(b) you have the right to provide such information.
5.3 You grant us a non-exclusive, worldwide, royalty-free licence to use such information for the purposes of:
operating the Services;
generating outputs;
improving and developing our services.
6. Third-Party Services and Bookings
The Services may include recommendations, links or integrations with third-party providers (including ticketing and booking services). Any transaction you enter into with a third party is solely between you and the third party.
6.3 We do not:
process payments;
control or guarantee the performance of third-party services.
6.4 We are not responsible for:
(a) the availability, accuracy, or content of third-party services;
(b) booking fulfilment, cancellations, or refunds;
(c) any loss or damage arising from your dealings with third parties;
(d) providing customer support relating to third-party bookings.
6.5 You should review the applicable terms and policies of any third-party provider before entering into a transaction.
6.6 Captivation AI is not a travel operator, travel agent, or merchant of record.
7. Affiliate Disclosure
7.1 We may receive a commission or referral fee where you make a purchase via a third-party.
8. Intellectual Property
8.1 Ownership
All intellectual property rights in the Services, including:
software;
design;
text;
AI systems, interfaces, conversational experiences, and generated platform content; are owned by or licensed to Captivation AI.
8.2 Limited Licence
You are granted a limited licence to use the Services for personal use only.
8.3 Prohibited Use
You must not reproduce, distribute, or exploit any content for commercial purposes without prior written consent.
8.4 Copyright and Trade Marks
The Captivation AI and V-Guides names, logos, branding, designs, and related materials are protected by intellectual property laws.
Nothing in these Terms grants any right to use any aspect of part of our intellectual property, branding, or proprietary materials except as necessary for personal use of the Services.
All third-party trade marks, logos, and brand names referenced on the Services remain the property of their respective owners.
9. References to Third Parties
9.1 The Services may reference or display the names, logos, trademarks, locations, images, public social media content, or other identifiers of third parties.
9.2 Such references do not imply:
sponsorship;
endorsement;
partnership;
affiliation; or
commercial association between Captivation AI Ltd and the relevant third party.
9.3 All third-party trademarks, logos, and brand names remain the property of their respective owners.
9.4 If you believe content on the Services infringes your intellectual property or rights, please contact us using the details provided below.
10. Privacy
10.1 We process personal data in accordance with:
UK GDPR;
Data Protection Act 2018.

11. Cookies
11.1 The Services uses strictly necessary cookies only.
11.2 These cookies are required for:
core functionality;
security;
performance optimisation.
12. Availability and Changes
12.1 We may modify, suspend, or discontinue the Services at any time.
12.2 We do not guarantee uninterrupted or error-free operation.
13. Fees & Paid Services
13.1 Certain parts of the Services may be provided free of charge.
13.2 We reserve the right to introduce paid features, subscriptions, enterprise services, premium functionality, advertising or commercial offerings at any time.
13.3 Any applicable fees, pricing, billing terms, or additional conditions will be clearly communicated before charges apply.
13.4 Unless expressly stated otherwise:
third-party bookings are charged by the relevant third-party provider; and
Captivation AI does not directly process payments
14. Limitation of Liability
14.1 Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for:
death or personal injury caused by negligence;
fraud or fraudulent misrepresentation;
any liability which cannot lawfully be excluded.
In any circumstances, the maximum liability of Captivation AI Ltd will be the annual subscription cost paid by you.
14.2 Subject to clause 14.1, the Services are provided on an “as available” and “as is” basis.
14.3 To the fullest extent permitted by law, Captivation AI Ltd shall not be liable for:
(a) inaccuracies, omissions, or errors in AI-assisted or third-party content;
(b) reliance placed on recommendations, itineraries, translations, venue information, or destination guidance;
(c) interruptions, delays, or unavailability of the Services;
(d) third-party services, bookings, cancellations, pricing changes, or booking fulfilment issues;
(e) indirect, consequential, incidental, or special loss or damage; or
(f) loss of profits, loss of opportunity, loss of enjoyment, or loss of data.
14.4 Users remain responsible for independently verifying important travel, pricing, accessibility, safety, and booking information before relying on it.
14.5 Separate commercial agreements may apply to paid, enterprise, subscription, partner, or white-label services offered by Captivation AI Ltd.
15. Indemnity
You agree to indemnify and hold harmless Captivation AI Ltd against claims, liabilities, damages, and expenses arising from:
your misuse of the Services;
your unlawful conduct;
your infringement of third-party rights;
your breach of these Terms.
This clause applies only to the extent permitted by law.
16. Termination
We may suspend or terminate your access to the Services at any time, including where you breach these Terms.
17. Force Majeure
We are not responsible for any failure or delay caused by events beyond our reasonable control.
18. Changes to these Terms
We may update, modify, or replace these Terms from time to time where reasonably necessary, including to reflect changes to the Services, applicable law, technology, or business operations.

By continuing to use the Services after any updates take effect, you agree to the revised Terms.

These Terms are governed by the laws of England and Wales.
Any disputes shall be subject to the courts of England and Wales unless applicable consumer laws provide otherwise.
